Patent Alternation in Malta  .  Change of Name / Address

Where there is no change in the person of the applicant or owner of a patent but there is a change in his name or address, a request for recordation of the change of the related patent details may be filed with the Malta IPO.

A single request shall be sufficient even where the change relates to both the name and address of the applicant or the owner and even where the change relates to more than one application or patent of the same person, or to one or more applications and one or more patents of the same person, provided that the numbers of all applications and patents concerned are indicated in the request.

Requirements

The filing requirements for Patent Alternations in Malta are the following:

  1. The Power of Attorney (POA Requirements);
  2. Documents showing proof of the change of name / address (only on request);
  3. The number of the application or patent concerned;
  4. The change to be recorded (name / address);
  5. The name and address of the applicant or the owner prior to the change;

Documents Showing Proof

Documents showing proof of the patent applicant's / owner's change of name or address are only required on request.
Exact document types are not defined. A document showing proof can be for e.g. an extract from the Companies House of the applicant's / owner's country, a copy of the applicant's / owner's ID Card or similar.


Alternation to European Patents  .  Change of Name / Address

After the EP Validation has been filed in Malta:
The change of name / address has to be recorded at the Malta IPO. The change request has to be filed with the Malta IPO even if the change has been recorded at the EPO.

Before the EP Validation has been filed in Malta:
The change of name / address has to be recorded at the EPO. The EPO will then inform the Malta IPO on the change.
There is no need to file an additional change request with the Malta IPO.
